68 Consent under the Commons Act 1899

In addition to the relevant provisions of the Acquisition of Land Act 19811, the Compulsory Purchase Act 19652 is subject to the Commons Act 18993 which provides that, where commons are specified for acquisition in the empowering enactment, they may be acquired under the terms of that Act4, but, where there is only a general authority to acquire land under the Land Clauses Consolidation Act 1845 acquisition will be invalid unless made by any government department or made with the consent5 of the Secretary of
