55 Determining factors for consent

In determining applications for consent the Secretary of State1 must have regard to2:

  1. 55.1

        the interests of persons with rights in the land or occupying it and in particular those exercising rights of common over the land;

  2. 55.2

        the interests of the neighbourhood;

  3. 55.3

        the public interest;

  4. 55.4

        any other matter considered to be relevant.

Public interest includes the public interest in nature conservation, the conservation of the landscape, the protection of public rights of access to any area of land and the protection of archaeological remains and features of historic interest3.
