54 Exceptions

The prohibition against carrying out restricted works without the consent of the Secretary of State1 does not apply to2:

  1. 54.1

        works, or works falling within a specified description, carried out under a power conferred in relation to that particular land by or under any enactment other than the mere grant of planning permission3;

  2. 54.2

        works authorised by or in pursuance to an enactment relating to common land generally;

  3. 54.3

        works authorised under a scheme under the Metropolitan Commons Act 1866 or the Commons Act 1899 without any requirement for any person to consent to the works;

  4. 54.4
