5 Definition of common land and rights of common

For the purposes of the Commons Registration Act 1965, and unless the context otherwise requires, ‘common land’ means1:

  1. 5.1

        land subject to rights of common whether those rights are exercisable at all times or only during limited periods; or

  2. 5.2

        waste land of a manor2 not subject to rights of common,

but does not include a town or village green or any land which forms part of a highway.
