44 Procedure for making schemes

A council must make and approve a scheme in the prescribed manner1 but if at any time before the scheme is approved the council receives written notice of dissent from either the person entitled as lord of the manor or otherwise to the soil of the common, or from persons representing one-third in value of such interests in the common as are affected by the scheme, and such notice is not subsequently withdrawn, the council cannot proceed further in the matter2.
