25 Transitional period for updating registers

The Commons Act 2006 Schedule 3 provides for a transitional period1, during which the registers may be updated to record qualifying events2. This period may start at different times in different registration areas3.

The qualifying events are4:

  1. 25.1

        the creation of a right of common, including those arising by prescription, after 2 January 1970 and before the commencement of the Commons Act 2006 Schedule 3 paragraph 2(2)5;

  2. 25.2

        any relevant disposition6 of a right of common, or any extinguishment of such a right, after the date of registration of the right and before the commencement
