24.5 Buildings registered as common land

Where the land was provisionally registered as common land but, at that date and continuously up to the date of the determination of the application or proposal, the land was covered by a building or was within the curtilage of a building and the provisional registration became final, the commons registration authority must remove the land from the register of common land1.

However there is only a limited opportunity for rectifying this mistake. Land may only be removed from the register if an application is made by any person, or a proposal
