90 Directors: developer’s directors

A developer may have rights to carry on ‘development business’. Development business may include the right to appoint and remove directors of the association. Any rights of the developer to carry on development business must be set out in the commonhold community statement1.

Where the commonhold community statement gives the developer the right to appoint and remove directors, the prescribed form of articles are to contain provisions enabling it to do so. These provisions are prescribed by regulations and are effective whether or not they have been adopted as part of the articles of the association2.
