75 Easements appurtenant to the common parts

Whether a commonhold is initially registered with or without unit-holders, the commonhold association becomes the registered proprietor of the common parts automatically1. There can thus be no express grant or exception and reservation of appropriate easements over other parts of the commonhold in a transfer by the developer.

The rights and duties of unit-holders and the commonhold association will thus depend entirely on the provisions of the commonhold community statement, as altered from time to time2.
