68 Charges

A commonhold community statement may not prevent or restrict the creation, grant or transfer by a unit-holder of a charge over the whole of his unit. A charge of part of a unit is of no effect1.

In principle, a charge of a commonhold unit is no different to a charge of any freehold property. The remedies of the chargee do not, however, extend to the disposal of part of a unit2.

The consent of a chargee of a unit is required to any amendment to a commonhold community statement which redefines the extent of the unit. Consent must be given in writing and before the amendment is made. The effect of an amendment which reduces the size of a charged unit is that the charge is extinguished in respect of the
