6 The solution in England and Wales

The problems identified in the leasehold ownership of flats1 have been addressed in England and Wales by the introduction of commonhold, although the application of commonhold is certainly not limited to flats. Commonhold ownership is a system of local law which is in many respects an improvement over leasehold and other freehold models. Commonhold gives flat owners (and owners of other commonhold units):

  1. 6.1

        the freehold of their flat or other unit;

  2. 6.2

        indirect ownership (through membership of the commonhold association) of the freehold of any common parts; and

  3. 6.3
