57 Agreement for sale and purchase

57.1 General

An agreement for the sale and purchase of an entire commonhold unit is, in many respects, no different to an agreement relating to any freehold property1. However, additional consideration should be given to making provision for the following:

  1. 57.1.1

        apportionment of the commonhold assessment and reserve fund levy;

  2. 57.1.2

        membership rights;

  3. 57.1.3

        implied easements;

  4. 57.1.4

        making the agreement conditional on an amended commonhold community statement;

  5. 57.1.5

        the commonhold association to be a party; and

  6. 57.1.6

        amendment of the standard conditions.
