53 Consumer protection

The terms of a disposition of a commonhold unit may be subject to the Consumer Rights Act 20151. The Consumer Rights Act 2015 applies2 where:

  1. 53.1

        There is a contract between a trader3 and a consumer4: Tenancies and leases may come within this definition5, and presumably freehold transfers may also be subject to the Consumer Rights Act 20156. Typically the first sale of a residential7 commonhold unit by the developer to an owner-occupier will be such a contract, whereas a second-hand sale from owner to purchaser is unlikely to be included within the definition.
