46 Tenants

There is a statutory duty imposed on the directors of the commonhold association to exercise their powers to facilitate the exercise by unit-holders of their rights and the enjoyment of their freehold estate in their units. This duty extends to tenants of units1.

The Commonhold and Leasehold Reform Act 2002 provides that regulations under the Act may impose obligations on the tenants of units, or may enable the commonhold community statement to do so, and may enable rights or obligations in the commonhold community statement to be enforced by or against the tenants of units2.
