28 Registration of commonholds: application

The freehold title to commonhold land must be registered at the Land Registry. If the freehold title to the land is not registered, it must, therefore, first be registered1.

The Chief Land Registrar is required to register land as commonhold where the commonhold comprises at least two units, where the land is not already commonhold, where the land is not prohibited from being commonhold, and where the application is accompanied by the requisite documents2.
