23 Registration of commonholds: consents

Consent is required (where applicable) from the following persons:

  1. 23.1

        The registered proprietor of the freehold estate in all or part of the land to comprise the commonhold. Where, as will normally be the case, the registered proprietor of the freehold in the land is also the applicant, he is deemed to have consented, and a separate consent is therefore not required from him1.

  2. 23.2

        The registered proprietor of a leasehold estate in all or part of the land originally granted for a term of more than 21 years: typically, it is only on the
