4: LIABILITY OF MEMBERS

130 Liability of members on winding up

The liability of members on the winding up of the commonhold association is limited to:

  1. 130.1

        any ‘liability which he may have under or arising out of the commonhold community statement’; and

  2. 130.2

        a contribution of £11.

A member’s liability under or arising out of the commonhold community statement will undoubtedly include any commonhold assessment or reserve fund levy outstanding in respect of his unit.

It is an open question whether a liquidator is able to raise assessments and levies in relation either to liabilities of the association arising before the commencement
