12 Suitability of commonhold: characteristics

12.1 General

The response of the commonhold legislation to the problems identified with leasehold ownership have already been mentioned in the abstract1. What is important in practice is whether the commonhold system of ownership is suitable for a particular scheme and whether commonhold is better than the alternatives of a (non-commonhold) freehold or a leasehold scheme. This paragraph seeks to identify the main characteristics of commonhold. The following paragraphs consider these characteristics from the standpoint of the developer and of unit-holders, and compare commonhold with (non-commonhold) freehold and leasehold schemes2. Issues
