105 Use

The use of a commonhold unit and of the common parts of a commonhold are subject to whatever restrictive covenants are noted in the registers of the titles.

A commonhold community statement must make provision about the use of commonhold units1. As a minimum it is considered that the commonhold community statement should state whether

or not the use of each unit is limited to residential purposes2 or to residential and other incidental purposes3. In practice it is likely that the commonhold community statement will, in the case of non-residential units, define the permitted use more precisely; by specifying the particular commercial or retail use permitted.
