104 Commonhold community statement Part 4: diversion of rent due from tenant

Where a unit or part of a unit is let, and the unit-holder has not paid any commonhold assessment or reserve fund levy (or any interest due), the commonhold association is able to require the immediate tenant of the defaulting unit-holder to pay amounts of rent due under his tenancy to the commonhold association in or towards discharge of the amounts outstanding from that unit-holder. It is immaterial whether the arrears relate to the unit that is let or to any other unit owned by the defaulting unit-holder1.
