75 Why and when should letter format be used for agreements?

A letter agreement format may be used:

  1. 75.1

        where one or both the parties wish to adopt a ‘friendly’ approach to the negotiations or to the relationship between the parties (the use of an agreement in a letter format can be indication of such an approach);

  2. 75.2

        where the agreement:

    1. 75.2.1

          is routine, or

    2. 75.2.2

          is not of great value to one or both parties, or

    3. 75.2.3

          is the accepted way certain contract or other transactions are set out1, or

    4. 75.2.4

          reflects the
