44 ‘Affiliate’

In an agreement there may be provisions that impose obligations and/or confer benefits not only on the party concerned but also to others who are related to that party. A definition of ‘affiliate’ (or some other similar word) may be included where an obligation or benefit is sought to be imposed or made available to someone other than a named party to a contract, for use later in the agreement.

Points to consider:

        Under English law there is no standard definition of an affiliate (or similar wording).

        The word ‘affiliate’ is not used in UK companies legislation,
