29 Matters particular to a deed

        Does the document state that it is intended to be a deed?

    1. 29.1.1

          Does it state at the commencement of the document that it is a deed eg: ‘THIS DEED is made on [date]’; and/or

    2. 29.1.2

          Does it state in the body of the document that it is a deed eg, does it contain the text ‘THIS DEED PROVIDES’ or, the more conventional, traditional wording ‘NOW THIS DEED WITNESSES as follows’ after the parties clauses (and background clauses, if any) and before the operative provisions; and/or

    3. 29.1.3
