279 General requirements for commercial communications constituting or forming part of information society service

A service provider must ensure that any commercial communication1 provided by him and which constitutes or forms part of an information society service must:

  1. 279.1

        be clearly identifiable as a commercial communication;

  2. 279.2

        clearly identify the person on whose behalf the commercial communication is made;

  3. 279.3

        clearly identify as such any promotional offer (including any discount, premium or gift) and ensure that any conditions which must be met to qualify for it are easily accessible, and presented clearly and unambiguously; and

  4. 279.4
