269 Additional payments

A consumer is only to pay the remuneration agreed for the trader’s main obligation under a contact. If the consumer is to make a payment in addition to the remuneration agreed for the trader’s main obligation then such sums must be expressly consented to by the consumer before the consumer becomes bound by the contact1.

The express consent of the consumer is not to be inferred where a consumer does not change a default option (such as a pre-ticked box on a website)2.
