268 Ancillary contracts

268.1 Meaning of an ancillary contract

An ancillary contact will exist where:

  1. 268.1.1

        there is an off-premises or distance contract (‘main contract’);

  2. 268.1.2

        another contract is related to the main contract (‘ancillary contract’);

  3. 268.1.3

        under the ancillary contract a consumer obtains goods or service which are related to the main contract; and

  4. 268.1.4

        the goods and services under the ancillary contract are provided by the trader or by a third party on the basis of an arrangement between the trader and the third party1.
