(b) Application of the right to cancel

261 The right to cancel

A consumer has the right to cancel a contract at any time during the cancellation period without giving reasons; and without incurring any liability other than where:

  1. 261.1

        the consumer has paid for a more expensive form of delivery than the least expensive common and generally accepted type of delivery the trader provides1;

  2. 261.2

        the handling of the goods by the consumer has caused a diminution in their value, where the handling is beyond what is necessary to establish their nature, characteristics and functioning2;
