222 Secondary contracts

If in one contract (‘Secondary Contract’) there is a contract term (‘Secondary Contract Term’) which either:

  1. 222.1

        reduces the rights or remedies of a person; or

  2. 222.2

        increases the obligations of the person;

in another contract (‘Main Contract), then the Secondary Contract Term is subject to the provisions of Consumer Rights Act 2015 Part 2 as if that term were in the Main Contract1.

It does not matter whether the parties to the Secondary Contract are the same parties to the Main Contract2; or whether or not the Secondary Contract is a consumer
