219 Meaning of ‘transparent and prominent’

219.1 ‘Transparent’

‘Transparent’ means1 that a term is expressed in plain and intelligible language2; and (if it in writing) is legible3.

In practical terms, ‘transparent’ will mean4:

  1. 219.1.1

        ordinary words should be used in their normal sense (as far as possible);

  2. 219.1.2

        sentences should be kept short;

  3. 219.1.3

        there should not be any vagueness in language which is has the effect of making the meaning unclear or misleading to the average consumer;

  4. 219.1.4

        there is clarity in the way terms are organised;
