211 Relationship of the provisions regarding unfair terms in the Consumer Rights Act 2015 to previous legislation

The implementation of Council Directive (EEC) 93/13 on unfair terms in consumer contracts into English law1 introduced a further method of controlling a consumer contract other than through other legislative measures such as the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 etc, namely through the concept of whether a contractual term was ‘fair’2.

The Consumer Rights Act 2015 now largely transposes the measures found in the Unfair Terms in Consumer Contracts Regulations 1999 into the Consumer
