198 Right to refund if trader does not have right to supply digital content

If the trader does not have the right to supply the digital content1 then the consumer has the right to receive a refund from the trader of all the money that consumer has paid to the trader for that digital content2.

If the trader’s failure only relates to some of the digital content supplied under a contract, then the right to refund is to apply to the part of the digital content which is not affected by the trader’s failure3.
