Digital content is supplied when the digital content reaches a device1, or, if earlier, when the digital content reaches another trader, chosen by the consumer, and that other trader provides a service by which the digital reaches the device2.
There is a contract to supply digital content by transmission where there:
is a contract to supply digital content; and
in order for a consumer to access the digital content it is necessary for the digital content to be transmitted to the device through arrangements
