19 Description and expression requirements

  1. 19.1

        The deed must be in writing1. ‘Writing’ can include handwriting (in pencil, pen or ink2), and also typing, printing, lithography, photography and other modes of representing or reproducing words in a visible form3.

  2. 19.2

        Writing can be placed on any type of physical material.

  3. 19.3

        The document to be made as a deed must make it clear that it is to be a deed, either by:

          Describing itself as a deed: This requirement can be satisfied in a number of ways:
