186.3 Matters which do not make goods of unsatisfactory quality

A consumer cannot complain of digital content being of unsatisfactory quality:

  1. 186.3.1

        where that defect is drawn to the attention of the consumer before the contract is made;

  2. 186.3.2

        where an examination is made by the consumer before the contract is made that ought have revealed the defect; or

  3. 186.3.3

        where the consumer examines a trial version before the contract is made, and the defect would have been apparent on a reasonable examination of the trial version1.
