186.1 Factors to be taken into account to establish satisfactory quality

Included in every contract for the supply of digital content is a term that the quality of the digital content is satisfactory1. Digital content is of satisfactory quality if it meets the standard that a reasonable person would consider satisfactory taking account of certain matters2.

Factors taken into account in assessing whether digital content is of satisfactory quality are:

  1. 186.1.1

        any description of the digital content;

  2. 186.1.2

        its price (if any);

  3. 186.1.3

        all other relevant circumstances3.
