179 Remedies for delivery issues

179.1 Failure to deliver

Unless there is an agreed time or period1, a sales contract is to be treated as including a term that the trader must deliver the goods without undue delay, and in any event, not more than 30 days after the day on which the contract is entered into2. Where this term is breached, and:

  1. 179.1.1

        the trader has refused to deliver the goods; or

  2. 179.1.2

        it was essential that delivery of the goods takes place at an agreed time or within an agreed period, taking in account all the relevant circumstances at
