178.4 Right to final rejection and reduction in amount refunded

If the consumer chooses the final right to reject, then the trader can reduce the amount she refunds to take account of the use that the consumer has had of the goods for the period since they were delivered1.

However, the trader cannot make a deduction:

  1. 178.4.1

        for use of the goods in any period when the consumer has had the goods only because the trader has failed to collect them at an agreed time2; or

  2. 178.4.2

        where the consumer has exercised the right of
