178.3 Circumstances when the right to a price reduction is not available

A consumer is not entitled to a price reduction when:

  1. 178.3.1

        prior to the reduction, what the consumer was required to transfer under the contract (whether actually transferred or not) cannot be divided up so that the trader can receive or retain only the reduced amount1; or

  2. 178.3.2

        something that the consumer is entitled to receive back in its original state2 cannot be returned in its original state3.
