176.5 Severable contracts

The 3 rights to reject are subject to qualification where1:

  1. 176.5.1

        the contract is a severable contract2;

  2. 176.5.2

        (in relation to the final right to reject) the contract is one for the hire of goods, a hire-purchase agreement, or a contract for the transfer of goods; and

  3. 176.5.3

        there is not a defective delivery of goods in respect of one or more instalments (if the goods are to be delivered in instalments)3.

If the above qualifications apply, then a consumer:

  1. 176.5.4

        may reject those goods to which a severable obligation
