168.2 Exception

However, a contract may provide that the trader and the consumer intend that the trader will transfer only whatever title the trader (or a third party) has (even if it is limited)1.

Where this Exception applies, the following will be included as a term of the contract:

  1. 168.2.1

        that all charges or encumbrances that are known to the trader, but are not known to the consumer, were disclosed to the consumer before the contract was entered into2;

  2. 168.2.2

        that the consumer’s quiet possession of the goods will not be disturbed:
