165 Goods to match model

There is a contract to supply goods by model if there is a supply of goods which:

  1. 165.1

        is made by reference to a model of the goods; and

  2. 165.2

        the model of the goods is seen or examined by the consumer1.

Every contract which is a contract to supply goods by model includes a term that the goods will match the model (except to the extent that any differences between the model and the goods are brought to the attention of the consumer before the trader and consumer make the contract)2
