161.3 Matters which do not make goods of unsatisfactory quality

A consumer cannot complain of goods being of unsatisfactory quality:

  1. 161.3.1

        where that defect is drawn to the attention of the consumer before the contract is made;

  2. 161.3.2

        where an examination is made by the consumer before the contract is made that ought have revealed the defect; or

  3. 161.3.3

        in the case of a contract to supply goods by sale by sample, where a reasonable examination of the sample ought to have revealed the defect1.
