161.2 ‘All other relevant circumstances’

A relevant circumstance includes a public statement made by the trader (or by the producer, or a representative of the trader or the producer) about the specific characteristics of the goods. Such a statement may be one made in advertising or labelling1.

However, a public statement is not a relevant circumstance where:

  1. 161.2.1

        the trader was not aware, and could not have been reasonably aware, of the public statement at the time the contract was made;

  2. 161.2.2

        the public statement was publicly withdrawn before the contract was made;

  3. 161.2.3
