161 Goods to be of satisfactory quality

161.1 Factors to be considered

Included in every contract for the supply of goods is a term that the quality of the goods is satisfactory1. Goods are of satisfactory quality if they meet the standard that a reasonable person would consider satisfactory2.

Factors taken into account in assessing whether goods are of satisfactory quality:

  1. 161.1.1

        any description of the goods3;

  2. 161.1.2

        the price or other consideration for the goods (if relevant)4;

  3. 161.1.3

        all other relevant circumstances5.
