108.5 Strict liability

Liability is strict as to the requirement that goods supplied under a contract are of satisfactory quality. This obligation will not be met:

  1. 108.5.1

        by the seller showing he has not been negligent; or has taken reasonable care in relation to the goods1; or

  2. 108.5.2

        by any defect being removed post-sale.
