107.2 What can amount to description of goods?

The description needs to identify the goods1 but must be more than a mere indication or identification of the goods meant2. The following can amount to a description of goods:

  1. 107.2.1

        statements concerning the location, age and use of goods3;

  2. 107.2.2

        the dimensions of a wooden stave4;

  3. 107.2.3

        that the goods were on a particular ship due to dock on a particular date5;

  4. 107.2.4

        that a painting is by a particular artist6; and

  5. 107.2.5

        that an item belonged to a particular person7.

If there is a description, then it must be a provision
