104 Default rules relating to contracts

104.1 Common law relating to contracts for goods1

The rules of the common law apply to contracts for the sale of goods, unless they are inconsistent with the provisions of the Sale of Goods Act 1979. In particular the following continue to apply:

  1. 104.1.1

        law of principal and agent; and

  2. 104.1.2

        the effect of:

    1. (a)

          fraud,

    2. (b)

          duress or coercion,

    3. (c)

          mistake,

    4. (d)

          misrepresentation, and

    5. (e)

          other invalidating causes.
