As is the case with EU law, the Competition Act 1998 sets out exemptions, restrictions and exclusions in relation to the application of Section 2 to agreements. However, whereas at present much of the Act is set out in general terms, EU law provides much additional legislation and guidance. The prohibition in Section 2 of the Competition Act 1998 does not apply1:

          mergers and concentrations,
