45 The provision of late night refreshment

Subject to exemptions1, the Licensing Act 2003 provides that ‘the provision of late night refreshment’2 is the provision by a person of either:

  1. 45.1

        the supply of hot food or hot drink to members of the public, or a section of the public, on or from any premises3 at any time between 11.00pm and 5.00am, whether for consumption on or off the premises4; or

  2. 45.2

        any time between 11.00pm and 5.00am when members of the public (or a section of the public) are admitted to any premises, that person supplies or holds himself
