34 Occupier’s and other liability

In an unincorporated members’ club, the contract of membership implies no warranty that the club premises are reasonably safe for the purposes for which the members are admitted1. If a members’ club is incorporated under the Companies Act 2006 or the Co-operative and Community Benefit Societies Act 20142, the corporate body becomes the occupier of the club premises and is required to exercise the same common duty of care as is required of the proprietor of a proprietary club3.
